Our process is broken down into 7 steps.
1. Application
Once you contact our office you will be asked to complete our online mis-selling test or alternatively we will carry out this process with you over the phone. This process is carried out so that we may obtain an understanding of your situation which will allow us to provisionally review your case.
2. Underwriting
Once you have furnished us with the relevant information an evaluation of your case is carried out by our in house specialists. We will evaluate and advise you of our initial findings. During this first review we will only be in a position to highlight areas of mis-selling as advised by you. Once this is attended to we will then advise you as to whether or not we believe you have grounds to make a claim against your lender/service provider.
3. Sign up
If we have advised you of a possible claim and you wish to proceed we will send you some initial documentation to sign and return to our office. This documentation will enable us to act on your behalf. During this ‘sign up’ stage we will also request our review fee. We may request that you furnish us with any other documents which we deem will assist us in dealing with your creditor directly. At this stage the document request fee may also be required when using some of our services in order to obtain a copy of your credit agreement or other such documentation. This document request fee is charged by your lender to obtain such documentation and the fee will be payable directly to the lender and not to our company.
4. Case Preparation
On receipt of all of the relevant signed documents from you we will contact your lender, request a copy of your credit agreement and advise the said lender that we have taken on your claim. Once the credit agreement is received a detailed investigation into your claim begins. Our team will evaluate and review your documentation and assess the potential of your claim.
5. Compensation Request
The necessary steps are then taken to notify your lender directly via our legal team setting out the basis of your claim and our assessment. Our legal team will demand that the lender acknowledge our findings and insist that the lender provide a detailed reply.
At this stage your case will go one of two ways:-
6. Legal Analysis
In the event that your lender does not respond positively to the request for compensation and your only course of action will be to take issue court proceedings against them after the assessment your claim file will be evaluated by our specialist legal team.
Our legal consultant will carry out a full legal analysis of your claim and in conjunction with you at which stage you will formally agree to legal proceedings being commenced on your behalf.
In the event that you do not agree to take any proceedings your claim will be at an end.
Prior to issuing court proceedings our legal consultant will correspond directly with you to advise you of the next possible steps and you will be advised of any risks which you may incur.
7. Claims Process
Legal proceedings will be prepared by our legal consultant. These proceedings are stamped by the relevant court, issued in the relevant court to your claim and served on the lender commencing court proceedings and your claim for compensation.
