Credit Cards like credit agreements are subject to fairness and the Consumer Credit Act. A lender has to comply the terms of this Act when issuing the credit otherwise the debt amassed on such an agreement may be deemed as invalid, flawed or unenforceable.
Some of the terms of the Consumer Credit Act require that the lender must
- Clearly state the interest & APR being charged
- Advertise the credit with no misleading adds
- State any variables in relation to the APR being charged
- Clearly state the credit limit
- Explain the cooling off procedure
- Explain relevant penalties and charges for missed payments and exceeding credit limits
- Issue you with your credit agreement within 10 days of singing it
If any of the above obligations have not been met by your lender you may have an unenforceable credit card.
What does unenforceable mean?
If your credit card debt is deemed as unenforceable it means that your lender will have no legal basis in which to enforce the debt.
What can happen as a result of this?
- You may be entitled to financial compensation
- You might be able to claim to have your entire balance written off, as an unenforceable contract will not give your lender any legal grounds to request repayment.
My credit card contract was not mis-sold, does this mean that I have not been treated unfairly?
The simple answer to this question is No. Unfortunately with credit cards mis-selling may have occurred after the credit was approved and taken.
You may have
- Been sold additional cover for payment protection insurance without actually requiring it
- Been sold travel insurance cover without it being requested
- Had your credit limit increased without a request by you to do so
- Received additional credit without requesting for it
